ANNUAL PROPERTY OWNERS MEETING

MEETING MINUTES - July 9th, 2006

Bill LaDuke opened the meeting at 1:00 pm

ROLL CALL AND INTRODUCTION OF PROPERTY OWNERS

Bill introduced himself and then asked everyone to introduce him or herself and state their address.

APPROVAL OF MINUTES OF 2005 ANNUAL MEETING
A motion was made and seconded to dispense with the reading of the minutes and to approve the minutes of the 2005 Annual Property Owners Meeting.

ELECTION OF ONE DIRECTOR
Bill LaDuke stated that one seat is open on the Board and one person is running; Rick Divine. Rick Divine was unanimously approved for the Board of Directors for a term of three years each.

FINANCIAL REPORT
Bill LaDuke presented the financial reports, including a review of the 12/31/05 Balance Sheet and Approved 2006 Budget Worksheet. Mr. LaDuke explained the new policy for collection of delinquent dues.

A motion was made to accept the financial report as presented and approve the 2006 Operating Budget for the Skyland Community Association. The motion was seconded and it passed with a unanimous vote.

CAPITAL PROJECTS
Bike Path:
Bill LaDuke provided a brief overview of the plan to construct and pave a new path from the existing path at the Post Office to a new bridge that would cross the Slate River upstream of the existing Highway 135 Bridge. In addition, negotiations are ongoing with the Club Cottages developer to extend the path along the wetlands just north of Skyland Drive to past the intersection of Skyland and Country Club Drive. The budget for this project is $50,000. In addition, planning is starting for a new path at Lake Grant and along upper Skyland Drive.

SKYLAND METROPOLIATN DISTRICT/EAST RIVER REGIONAL SANITATION DISTRICT UPDATE
Woody Sherwood, Vice-Chairman of each District's Board provided the owners an update on projects each District has completed or is working on:

Skyland - The District is financial healthy with approximately $900,000 in reserves. Several water exploration and storage projects are in the planning phase. These include:
A. The application for the enlargement of Lake Grant has been submitted to the State Engineer. If approved, the approval is valid for 5 years
B. Three new water wells were drilled last fall. Two of the three produced substantial amounts of water. These wells, coupled with the existing Lake Grant Inlet Well will be pump-tested this fall. The water quality results from the lab indicate good water quality
C. An "intent to purchase" water proposal has been submitted to buy water from a source outside of Skyland. This water could be used for the Golf Course Irrigation, augmentation or to keep Lake Grant full
D. A plan to pump back East River Drainage Water to the Slate River is being engineered to help satisfy future water calls and Skyland augmentation requirements
E. The new water billing and meter project is complete and over the next 5-7 years, the District anticipates user fees to offset the production of water so this budget is not supplemented by property taxes
F. The District is "fine-tuning" their water master plan and augmentation plan
G. At this point, building a new reservoir north of the Country Club Cul-de-sac (noted as Columbine Reservoir) has been lowered on the District's priority list

East River - The District is in the preliminary planning stage of constructing a new or enlarging the existing treatment plant. The plant is necessary as the Colorado State Public Environment and Health Department has imposed more strict effluent standards specific to ammonia treatment. The district will most likely be asking the East River Electors to vote on a bond authorization question, permitting the district to borrow the money needed (approximately 6 million dollars) for this project. The goal of the district would be to secure a favorable bond, including a low interest rate to help defray any potential mill levy increase to property owners within the District. Several questions were asked and Mr. Sherwood provided answers.

ND ENTERPRISES - UPDATE FROM THE DEVELOPER
Garrett Simon, Development Manager provided the owners an update on projects and plans the developer is working on. The developer is marketing for sale all remaining lots (except 12 above Lake Grant) at Skyland and all units at Club Cottages. They are also marketing units at the base of Crested Butte Mountain and exploring an agreement to allow Club Memberships for those owners and owners that buy lots at Skyland memberships in the mountain (Alpine) Club. The developer is also planning a small remodel at the Clubhouse. Mr. Simon fielded several questions and provided answers.

OTHER MATTERS THAT MAY PROPERLY COME BEFORE THE MEMBERSHIP
Design Guidelines - Frank Alfone summarized revisions under consideration to the existing Skyland Design Guidelines. These changes include:
1. New Exterior Lighting Language
2. Solar Panel Language
3. Modified Landscaping (more points needed) requirements
4. Consideration of alternative roofing material

Additionally, Mr. Alfone reminded all owners to call his office prior to performing any exterior alterations to their home and to review the latest guidelines as the Board changes them periodically.

A new website for Skyland should be up and running by 8/1/06 (www.skylandonline.com). In addition, the Districts will offer automatic payments for water and sewer charges by 10/01/06.

The following comments and suggestions were made during a question and answer session:
A. Require that new and existing owners mitigate noxious weeds
B. The Larkspur Neighborhood will most likely get final approval in mid-July
C. Add a small bike/pedestrian logo above the small stop signs on the paths in Skyland

The homeowners ratified the actions of the board for the past year.
